Lessee Terms and Conditions for Sailfest 2008
1. Absolutely NO REFUNDS will be issued to Lessee for any reason.
2. Lessee must have a Connecticut Sales Tax Number on the first
day of the event. Applications for Connecticut Sales Tax Numbers
can be obtained by calling (860) 425-4123. The processing time
for an application by mail is five to six weeks. Forms may be
processed in person at the Connecticut State Sales Tax Office
at 2 Cliff Street, Norwich, CT 06360. An inspector from the Department
of Revenue Services will be onsite to check CT Sales Tax Numbers
at the check in location.
3. Lessee must furnish proof of business liability insurance with
Downtown New London Association (hereinafter “DNLA”)
named as additionally insured in order to have an application
processed. DNLA retains the right to refuse to process applications
submitted without the proper proof of insurance.
4. All selling units must be contained within the designated space,
inclusive of generators, and have no extension or overhang over
the walkway or adjacent spaces.
5. Lessee must list all items to be sold / distributed and sell
/ distribute only those items at the event. Any Lessee selling
unauthorized items will be first warned then expelled from the
event. For exclusive rights to a particular merchandise item,
Lessee must negotiate with DNLA. The D.N.L.A. reserves the right
to pull from sale any items it deems inappropriate at anytime.
6. Lessee may not sublease a space.
7. Lessee must submit color photos of their booth with a diagram
of the setup to DNLA with the application.
8. The sale / distribution of alcohol, tobacco, firearms, fireworks
of any kind and glow items by Lessees are strictly prohibited.
9. No claims for injury to any person or damage to or loss of
property because of fire, theft, or any other cause, shall be
made against DNLA, its officers or agents, by or for the Lessee
because of this agreement.
10. Lessee agrees to indemnify the DNLA and the City of New London
and hold it harmless of and from any and all claims for personal
injury, death or property damage and any other losses, damages,
charges or expenses, including attorneys’ fees, which arise
out of, in connection with, or by any reason of use of the space
provided herein, by Lessee.
11. It is agreed that the DNLA will not be liable for conditions
caused by war, acts of terrorism, insurrections, riots or acts
of God. In such an event, the DNLA’s liability is limited
only to the return of all rental monies previously paid by Lessee.
12. Lessee is required to participate on each scheduled day of
the event from open to close. Your booth must always be occupied
at any time, never leave unattended.
13. DNLA retains the right to refuse Lessee’s continued
participation in the event and to bar from future events for failure
to comply with the terms of this agreement or for any other reason.
14. Lessees selling food will be inspected and must meet the requirements
of The Ledge Light Health District. The Ledge Light Health District
will hold instructional classes to obtain a temporary food service
license. The district will charge a fee and you must contact The
Ledge Light Health District prior to the event at (860) 448-4882,
1 Fort Hill Rd., Groton, CT 06460. Any Lessee who fails to meet
Health District requirements as determined by The Ledge Light
Health District will not be allowed to participate in the event
and no refund will be issued.
15. Lessee must acknowledge Sailfest exclusive sponsorships. All
Lessees selling items that have an exclusive sponsorship with
SAILFEST are required to sell that company’s product and
no competitor’s product. (i.e. Beverages)
DNLA RETAINS THE RIGHT TO REFUSE TO PERMIT VENDORS WHO FAIL TO
COMPLY WITH THE TERMS OF THIS PARAGRAPH TO PARTICIPATE IN THE
EVENT AND NO REFUND WILL BE ISSUED.
Lessee is responsible for timely and thorough set-up, breakdown
and cleanup of entire space. Lessee will comply with Sailfest’s
minimum safety requirements set forth by the NLFD and The Ledge
Light Health District.
Vendor booth spaces are issued on a first come first serve basis.
Requests for electricity may alter your space assignments. All
applications must be returned to DNLA by June 18, 2008.
The Downtown New London Association reserves the right to decline
applicants based on merchandise type, number of lessees registered
in the category, or appropriateness of merchandise. Lessees may
request space preference. However, this does not guarantee the
space. DNLA’s Sailfest Committee will work to accommodate
the lessee within the festival guidelines. The DNLA Sailfest Committee
will assign booth space on an “as received” basis
according to type of merchandise or food offered, power needs
and general layout of festival at DNLA’s sole discretion.
